Terms of Service

This is my TOS, at any point I observe you violating it I have every right to refuse you service and terminate in-progress commissions without refund or reimbursement.

General TOS Overview

Do Not claim to own the art I make you, others, or myself
Do Not post/re-post my art without crediting me properly
Do Not attempt to profit off of my work without permission
Do Not put my art into anything AI or NFT based
Do Not attempt to remove my watermark and/or signature
Do Not remove or edit credit notes on reference sheets
Do Not directly trace over my art to make your own "art"
Do not re-sell, re-design, co-own, or claim credit for original design of adopts without permission
Do Not attempt to haggle my prices lower then what I initially offer, especially if I say no
I require some form of proof that you are 18+ if you want a NSFW comm
Do Not request anything suggestive or NSFW from me as a minor
Do Not try to get personal with me during the commission, business is strictly business
No Refunds after final sketch, period
Do Not pressure me to draw anything against my comfortability or to finish your comm faster
If you cancel the comm on me after the final sketch, you still not be receiving a refund
Do Not request removal of my watermark or signature
If the watermark is obnoxious, you can request it be resized, moved, or that the transparency is adjusted (I have every right to refuse this request)
If the signature is obnoxious, you can request it be resized, moved, re-colored, or that the transparency is adjusted (I have every right to refuse this request)
I have every right to refuse to make edits if the requested edit is something I feel I cannot reasonably make (ex; requesting I change the hair after I have finished and finalized the line art)
To prove that the comm you recive is not stolen art, I give all my customers permission to display our DM's on an as needed basis
Do Not draw on or make edits to your comm without my permission
I have every right to post the art I make even art you pay me to make, do not demand I take it down without reasonable grounds
I reserve the right to deny making certain requests for any reason regardless of the circumstance
My comms are a finnish-based-on-motivation basis, meaning just because you took my first slot does not mean I have to finish your comm first, and also means I will work at my pace
Do Not put me up to a strict deadline for a comm, I work at my pace

Payment Terms

A form of payment will be required before I start work on your commission(s), whether that be the full amount up front or 50% up front to seal you comm and the other 50% later on in the commission (typically at a 75-95% progress mark)
If you choose the 50-50 Payment route keep in mind that the first 50% starts the work, the last 50% finishes it; if you fail to make the final 50% payment I reserve the right to drop your comm and you as a client
I provide budget friendly services, however I will not tolerate begging
All tips are non-refundable
Before pay I will give an estimate based on what the request is, do not rush this process
Do Not send me any payment before I have agreed to give you a slot and requested the payment
Nitro and VRChat Gifting as a payment method is subject to be paid 100% upfront, no exceptions
In the event that I agree to refund, do not request a chargeback, I will transfer the money back to you
If at anytime you decide during the commission that you do not wish to pay the rest of your due amount or do not want to wait for me to finish, walkouts subject you to refusal of service in the future

Legal Terms

I, Neko Delta, as the original artist of all my signed and watermarked works, claim the rights to the produced drawings, not the buyer. Therefore I am allowed to use the copyrighted artwork to;

Promote myself with any of my work as I wish
Publish and display my artwork in my own posts, forums, social medias, etc
Share my experience creating the artwork publicly, both positive and negative experiences

My work is (CC) Attrib. NonComm. NoDerivs.
Put simply, this means you are allowed to use and share the work you have commissioned from me as long as it is shared with credit back to me.
Therefore you as the consumer are allowed to;

Use the commissioned piece for personal use unless agreed otherwise (upload it to your social medias, profiles, forums, etc)
Print the artwork and claim the character(s) as their own, but not the artwork itself
Send the art to others as long as there is proper credit and the peice is not subject to profit

The following is considered copyright infringement and a violation of these terms;

Reproducing/reusing the commissioned artwork commercially
Claiming the artwork as your own work
Removing my signature and/or watermark from the artwork
Altering or tracing the artwork without my consent

The moment you contact and set up a commission with me, you are agreeing to the these terms and conditions of my services and understanding what you are agreeing to.
